Welcome to Mae. These Terms of Use (“Terms”) govern your access to and use of Mae’s websites, mobile application (“Mae App”), and related products and services (collectively, the “Services”), operated by Maecenarts UG (“Mae”, “we”, “us”, or “our”), Legiendamm 14, 10179 Berlin, Germany.

By creating an account, joining an experience, purchasing a ticket or artwork, hosting an event, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Who we are & what Mae is

Mae is a social art platform. Through the Mae App and web Services, we enable members and guests to discover art, attend and host cultural experiences and events, connect with other people in the community, browse Magazine editorial content, participate in facilitated conversations (including symposium-style formats), list and purchase artworks, and engage with partner productions.

Core features of the Services may include, without limitation:

  • member profiles, discovery, and messaging;
  • Mae experiences and events (registration, tickets, check-in);
  • membership and subscription access;
  • artwork listings, offers, and marketplace transactions;
  • Mae Magazine and related editorial surfaces;
  • facilitated group conversations, questions, and symposium formats;
  • experience documentation, recordings, podcasts, and resource archives (see Section 8);
  • partner, brand, and cultural-production collaborations.

2. Eligibility

The Services are intended for users who are at least 18 years old, or the age of legal majority in their jurisdiction. If you are a minor, you may only use the Services with consent of a parent or legal guardian where permitted by law. By using the Services you represent that you meet these requirements and have capacity to enter a binding contract.

3. Accounts & membership

Some features require an account and/or an active membership. You are responsible for the accuracy of information you provide, for keeping login credentials confidential, and for all activity under your account. Notify us promptly at hello@mae.community if you suspect unauthorized access.

Memberships and subscriptions may renew automatically according to the plan selected at checkout (for example, monthly). You may cancel renewal before the next billing date through the App or by contacting us. Fees already charged are generally non-refundable except where required by law.

We may review applications and memberships, and may approve, refuse, suspend, or terminate access where we reasonably believe it is necessary to protect the community, comply with law, or enforce these Terms.

4. Experiences, events & tickets

Mae and third-party hosts may offer experiences and events through the Services. Ticket purchases and registrations may be processed by Stripe or other payment providers. Platform service fees (for example, up to 5% on certain ticket sales) and payment-processor fees may apply and will be disclosed or reflected at checkout where required.

Event hosts are responsible for the accuracy of event details and for conducting the experience safely and lawfully. Mae may facilitate discovery, ticketing, messaging, and check-in tools, but unless Mae is expressly identified as the organizer, Mae is not the producer of every event and is not responsible for the conduct of hosts, venues, or other attendees.

Ticket refund and cancellation rules depend on the specific event and applicable law. Dinner or experience tickets may be non-refundable within a stated window before the event (for example, 72 hours), as disclosed at purchase. See also our Condition of Sale for marketplace transactions.

5. Community conduct

Mae is a curated community. You agree to treat other members with respect and not to harass, discriminate, threaten, spam, scrape, or otherwise abuse the Services or other users. You will not post illegal, infringing, deceptive, or sexually exploitative content. Artistic nudity may appear in educational or artistic contexts; pornography and sexually gratifying content are not allowed.

We may moderate content, remove material, limit features, or suspend accounts that violate these Terms or undermine the safety and trust of the community.

6. User content

You retain ownership of content you submit (profiles, messages, images, listings, comments, and similar “User Content”). You grant Mae a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt, publish, publicly display, distribute, and otherwise use User Content as needed to operate, improve, promote, and provide the Services — including matchmaking, personalization, marketing of the platform, and editorial or archival uses consistent with these Terms and the Privacy Policy.

You represent that you have all rights necessary to grant this license and that your User Content does not infringe third-party rights.

7. Artwork marketplace

Where the Services allow listing, offering, or purchasing artworks, Mae typically acts as an intermediary marketplace and payment facilitator, not as the owner or guarantor of every work (unless Mae is expressly identified as the seller). Sellers are responsible for accurate descriptions, authenticity representations, shipping options, and lawful sale. Buyers are responsible for reviewing listings before purchase.

Marketplace fees, taxes, shipping, and buyer protections are described in the Condition of Sale and, where applicable, the Mae Guarantee.

8. Experience documentation, recording & archives

Mae experiences are designed to be shared cultural moments. By attending, participating in, hosting, or otherwise taking part in a Mae experience, event, symposium, dinner, or related gathering offered through the Services (an “Experience”), you acknowledge and agree that:

  • Mae and/or authorized partners may photograph, film, audio-record, or otherwise capture the Experience, including participants, artworks, venues, conversations, and surrounding atmosphere (“Experience Materials”);
  • you grant Mae a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, edit, adapt, translate, distribute, publicly display, publicly perform, broadcast, stream, and create derivative works from Experience Materials that include your name, likeness, voice, image, statements, and contributions, in any media now known or later developed;
  • Mae may use Experience Materials for community storytelling, editorial content (including Mae Magazine), marketing and promotion of Mae and partner productions, educational resources, research and product improvement, podcasts and audio series, video series, and a resources / cultural archive maintained by Mae;
  • participation in an Experience may be conditioned on this license; where a specific Experience requires additional written release or opt-out mechanics, those instructions will be communicated for that Experience and will control to the extent of any conflict;
  • you will not disrupt documentation undertaken in good faith, and you will not record other participants in private or sensitive contexts without their consent where required by law.

If you believe Experience Materials depicting you should be reviewed for removal from a public marketing surface, contact hello@mae.community. We will consider reasonable requests in light of editorial, contractual, and legal obligations, without guaranteeing deletion from all archival or already-distributed uses.

9. Magazine, symposiums & editorial

Mae Magazine and related editorial or symposium features are provided for cultural and informational purposes. Opinions expressed by authors, guests, or participants are their own. We may update, archive, or remove editorial content at our discretion.

10. Partners & third parties

The Services may include partner productions, venue collaborations, and links to third-party sites or tools (including Stripe, analytics, maps, messaging infrastructure, and cloud hosting). Third-party services are governed by their own terms. Mae is not responsible for third-party content or practices except as required by law.

11. Intellectual property

The Mae name, logos, App, website design, software, and Mae-owned content are protected by intellectual property laws. Except for the limited license to use the Services as intended, no rights are granted to you. You may not copy, scrape, reverse engineer, or commercially exploit the Services without our prior written consent.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, MAE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted availability, that matches or experiences will meet your expectations, or that User Content or Experience Materials are accurate or complete.

You are solely responsible for your interactions with other users and for your attendance at Experiences. Take reasonable precautions when meeting in person or sharing personal information.

13. Limitation of liability

To the fullest extent permitted by applicable law, Mae and its directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Mae’s aggregate liability for claims relating to the Services will not exceed the greater of (a) the amounts you paid to Mae for the Services giving rise to the claim in the twelve (12) months before the claim, or (b) EUR 100, except where liability cannot be limited under German law (including liability for intent, gross negligence, injury to life, body, or health, or mandatory product liability).

14. Indemnity

You agree to indemnify and hold harmless Mae from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Services, your Experiences as a host, your marketplace activity, or your breach of these Terms, except to the extent caused by Mae’s willful misconduct.

15. Suspension & termination

You may stop using the Services and request account closure by contacting us. We may suspend or terminate access for violations of these Terms, inactivity, legal compliance, or protection of the community. Provisions that by nature should survive (including licenses to Experience Materials already captured, IP, disclaimers, and liability limits) will survive termination.

16. Changes

We may update these Terms from time to time. The “Updated” date above will change when we do. Material changes may also be communicated in the App or by email. Continued use after the effective date constitutes acceptance of the revised Terms.

17. Governing law & venue

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. Courts in Berlin, Germany shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
